Due to the coronavirus pandemic and related economic problems, many tenants in Turkey have stopped paying their rent on time. What about the owners of the rented housing in such cases? Takvim Gazetesi has published instructions on this matter.
The relationship between the owner of real estate in Turkey and their tenant is regulated by Article 299 of the Turkish Code of Obligations. According to the article, the lease agreement imposes obligations on both the tenant and the landlord of an apartment in Turkey. The terms and size of the rent (as well as the schedule for its repayment) must also be specified in the contract. Tenants are required to pay rent at the end of each month or at the end of the lease term (unless the contract specifies that the rent must be paid in advance, on the eve of the next month).
To make tenants who do not pay on time move out, a landlord must:
- notify in writing the tenant about the period during which they must pay off the debt, otherwise the contract will be terminated (as a rule, the minimum period is at least 30 days);
- file a claim for eviction in the Magistrate's Court on the basis of violation of the rights of the lessor;
demand the eviction of tenants by court order.
