Excessive overstatement of rent is fraught with prison

Lawyers warned the owners: since the authorities are now especially careful that homeowners do not behave unfairly towards tenants, excessive thirst for profit can be fraught not only with fines, but also with imprisonment. And it is up to a year. 

 

These measures, on the one hand, are very beneficial to tenants, among whom there are many Russian immigrants who, until they decide on buying a home, decided to temporarily live in Turkey for a year or so, renting an apartment. On the other hand, it is necessary to be attentive to compliance with local laws not only for Turkish owners, but also for foreigners who have housing in Turkey and rent it out.

The reason for the current «sanctions» is the situations that happen all the time when owners raise the rent three or four times, despite the fact that the officially permitted percentage of increase in the rental tariff with the annual extension of the contract is 25%. This rule will be in effect until July 1, 2023. Currently, landlords do not have the right to demand from the tenant an increase in the rate by a percentage more than mentioned. Nevertheless, there are still a lot of violators, so it comes to quarrels, disputes, demands to vacate the premises; tenants are increasingly going to court in an effort to defend their rights. 

 

Those who, while living in rented housing in Turkey, face similar cases, are urged by the regulatory authorities to collect evidence (such as correspondence in social networks, SMS messages, etc.) and go to court. In the first confirmed case, the court will limit itself to a warning and/or a fine, but if the owner does not moderate his «appetites», he may actually end up in prison for a period of 3 months to 1 year, if the court deems it justified.

 

Thanks to the efforts of the authorities, the market for renting and selling housing is becoming more and more «transparent». the new electronic identity verification system (EKDS) will now help to protect the buyer from purchasing real estate using a fake TAPU.
