Dishonest neighbors will now be reasoned with by intermediaries

Starting from September 1, 2023, the rules of disputes concerning problems with the "neighborhood" in apartment buildings and residential complexes (cite) in Turkey will change somewhat.

 

Quarrels periodically arise between local residents for a variety of reasons; most often it concerns infringement of someone's interests or damage to someone's property. Previously, residents called the police and sued; however, at the end of the summer, it was decided to change the situation with control over this issue, due to an overabundance of such complaints, overloading the judicial system.

 

So, due to the increased burden on the courts, some "castling" has been carried out - legal regulation. And from September 1, all disputes between neighbors within the same residential building or a sieve will first of all be referred to intermediaries-mediators. Well, if the mediator is unable to settle the issue and find a solution that suits both sides, then the applicant gets the right to submit the complaint to the court by opening a case.

 

Let us clarify that the involvement of intermediaries will concern a variety of issues: accidental flooding of apartments on the floors below by the owners of the upper ones, unpleasant odors, accidental damage to cars on the territory of the sieve (for example, due to falling flower pots from balconies on cars standing under the windows), drivers occupying other people's parking spaces, "expropriation" of part of public areas for personal use and so on. The mediator will first try to solve the issues of finding compromises; he will also deal with an objective assessment of the loss, if any.

 

Such an intermediary is also called upon to facilitate the activities of the management company, in matters of non-payment of aydat by unscrupulous owners of residences in a particular sieve.

 

It is particularly specified that the newly endowed with "regulatory rights" are unbiased, so that discrimination based on nationality, gender, presence or absence of a passport of a citizen of the Republic of Turkey will be excluded.

 

As for the recent changes in the letter of the law: an attempt to pass through parliament a law banning the sale of housing to foreigners has not been successful.

 

Also, in the light of the February events in the housing rental segment, the parties to the contract have the right to terminate this contract without any compensation payments to the other party if the building is considered risky.
