Apartment buyers in Turkey can force unfair builders to fix defects or pay for improvement works

The owners of Turkish housing, who find defects in the purchased apartments, can sue construction contractors and force them to make repairs or pay for repairs. This information was published today by the construction and real estate newspaper in Turkey Emlak Kulisi. After a residential complex is completed, the owners of new housing may find defects that were not taken into account when the object was commissioned or that appeared later. In order to eliminate defects by the developer, apartment owners in Turkey can go to court and call a special expert commission, which will confirm the facts of defects. Then the contractor can be sued for repairs or payment for fixing these defects: whether it be apartments or common areas of a residential complex. However, there is a nuance: it is only the first owner of a new apartment, who bought it directly from the developer, has the right to file a claim against the contractor.
